1. Who we are

windowshoppers.uk is operated by Momently Ltd, a company registered in England and Wales, company number 17280873, registered office 201 Broadway Lane, Bournemouth, BH8 0AD. Contact: hello@windowshoppers.uk.

By using this website you agree to these terms. If you do not agree with them, please do not use the site. Our privacy policy explains what we do with personal information, and our listing terms apply if you claim or pay for a business listing.

2. What Windowshoppers is — and what it is not

Windowshoppers is a directory. We publish information about local businesses so people can find them.

We are not a party to anything that happens between you and a business you find here. We do not supply the goods or services listed, we do not vet or endorse the businesses in the directory, and we do not guarantee the quality, safety or legality of anything they provide. Any contract you enter into is between you and that business.

A business appearing in the directory — including one paying for a listing — is not a recommendation by us.

3. Accuracy — please read this one

We work hard to keep the directory accurate, and we show you the source and date of individual facts so you can judge them for yourself. But most listings were compiled from public sources rather than supplied by the businesses, and information goes out of date.

Check with the business before relying on anything here — particularly opening hours, prices, and whether a business is still trading.

Where we show an indicator such as “Open now”, it is calculated from opening hours we have recorded. We only show it where those hours have been confirmed, and we show when they were last confirmed. It is still a guide, not a promise.

Food hygiene ratings come from the Food Standards Agency and are correct as at the inspection date shown. Ratings change; the FSA’s own website is the authoritative source.

4. Your account

Accounts are free. We use passwordless sign-in: you give us an email address and we send you a link. You agree to:

• give us an email address you actually control, and keep access to it;
• not share your sign-in link with anyone else;
• not create accounts automatically or in bulk;
• tell us at hello@windowshoppers.uk if you think someone else has got into your account.

You can close your account at any time by emailing us. We may suspend or close an account being used to break these terms, to claim listings the account holder is not entitled to claim, or in a way that harms other users or the service. Where we do that we will tell you why, unless we are prevented from doing so, and you can challenge it by replying to us.

5. What you may not do

• copy, scrape, or systematically extract the directory or any substantial part of it, whether by automated means or otherwise;
• use the site or anything on it to send marketing to the businesses listed, or to build a marketing list;
• claim a listing for a business you are not authorised to represent;
• submit anything false, misleading, offensive, defamatory, or that infringes someone else’s rights;
• attempt to interfere with the site’s security or availability, or access parts of it you are not authorised to reach;
• reproduce our content on another site or in another product without our written permission.

The directory as a compiled whole is our property and is protected by database rights and copyright, even where individual facts within it are not.

6. Content other people provide

Businesses that claim a listing can add their own content — descriptions, photographs, announcements, owner biographies. That content is theirs, not ours. They are responsible for it, and they warrant to us that they are entitled to publish it.

We do not check everything before it appears. We do moderate, and we will remove content that breaks our rules, but we cannot promise to catch everything immediately.

7. Content we compile ourselves

Some content — the factual details of unclaimed listings, and descriptions written from information published on a business’s own website — is compiled by us. We show its source and date.

We take responsibility for that content, and the correction route above applies to it. If you run a business and you disagree with anything we have published about it, email us and we will correct or remove it. See also our privacy policy, which sets out your right to object.

8. Links to other websites

The directory links to businesses’ own websites and social media. We do not control those sites and we are not responsible for their content, their accuracy, or what they do with your information.

9. Availability

We try to keep the site running, but we do not promise it will always be available or free of errors. We may change, suspend or withdraw any part of it, and we may change these terms. Where a change materially affects you and we hold your email address, we will tell you.

10. Our liability to you

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. If you are a consumer, nothing here affects your statutory rights.

Otherwise, and to the extent the law allows:

• We provide the site “as is”. We do not guarantee that the information in it is accurate, complete or current, for the reasons explained in section 3.
• We are not liable for any loss arising from your dealings with a business you found through the directory.
• We are not liable for business losses — loss of profit, business, contracts or anticipated savings.
• We are not liable for loss that was not reasonably foreseeable when you started using the site.

If you are a business user, our total liability to you in any 12-month period is limited to the amount you paid us in that period, or £100 if you paid us nothing.

11. Law and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in your own country’s courts.
